Giambrone instructed by VCast, one of the leading Start Ups in Italy

Giambrone’s Insolvency Team has successfully represented VCast Ltd, one of the most interesting start-ups headquartered in London, in the defence of a Winding-Up Petition filed by Boing S.p.A.

Giambrone instructed Dirk van Heck of ShenSmith Chambers, an Astbury and Jules Thorn Scholar of the Middle Temple and a Senior Scholar of Trinity College, Cambridge, to appear before the High Court to oppose Boing’s petition.

VCast is a PVR Cloud, hardware-less, which allows to record, on the move, any of the TV channels free to air DVB program and review them in deferred on any TV, PC or device mobile, through PC / Tablet / Smartphone / Smart TV.

It is a leading provider of Interactive Video Broadcasting Services, Systems and Network that enhances traditional Internet and Intranet communication by transforming the live or on-demand video and audio visual content to worldwide audience’s fingertips.

Having successfully defended VCast, Gabriele Giambrone, Managing Partner of the firm, commented: “This case shows how courts will not usually look favourably on insolvency proceedings being instigated as a commercial tool to put pressure on competitors. Our client has current initiated anti-infringement proceedings before the Enterprise Section of the Court of Turin, and we are confident that VCast will successfully be able to continue operating and growing into the Italian online digital market, notwithstanding the fierce opposition of traditional TV channels such as RAI and Mediaset”
