Debt Recovery in Morocco

Injunction Decree: This quick and convenient method allows for the recovery of a debt. The procedure can be used if the debt arises from a contract (e.g., a purchase from a merchant or a bank loan) or a contractual obligation (unpaid invoice, bank debt, unpaid rent). 

Accelerated and Monitoring Procedure: A British creditor, through their lawyer in Morocco, can file a request for debt recovery through an accelerated and provisional procedure if the debt is certain, liquidable, and enforceable, and there are no serious disputes on the obligation.

Ordinary Merit Procedure: If a Moroccan debtor raises a serious dispute about the existence of the obligation, it is necessary to initiate an ordinary merit procedure. The duration of such processes is longer than the accelerated procedure and may take from 6 months to 1 year, depending on the complexity of the case.

Judicial Liquidation Procedure: If the Moroccan debtor is insolvent, it is possible to request the judicial liquidation procedure (bankruptcy) of the debtor.
