The Supreme Court clarifies the Equality Act 2010

The Supreme Court has clarified that under the Equality Act 2010, claims related to references to women should refer to the biological gender at birth. Meaning that gender based rights and protections under the Act refer only to persons born biologically female.  However, this does not remove the rights and protections with regard to discrimination against transgender women.  Such women are still protected against direct discrimination and harassment and can bring a claim against harassment and gender discrimination if being harassed due to their female appearance due to being a transgender woman.
