The US Election - Will It Affect UK Immigration

In the current global political climate, information related to immigration can be difficult to understand. Following the results of the November 2024 US election, there were many questions around the nature of immigration between the US and UK. In fact, searches around moving to the UK from US increased by 900% between November 4 and 6, highlighting that interest in immigration is at a high. In our 2024 study, we found that 29% of people in the US are worried that the results of the US election could affect them visiting and/or moving to the UK. But what is the reality, and how can immigration lawyers help?

In our guide and research, we will explore what a Trump victory really means for the UK, whether emigrating to the US will be harder for UK nationals and outline the steps of applying for a Visa in the US from the UK. We will also explore whether you need to instruct a lawyer to assist with the application to move to the US and how our immigration lawyers at Giambrone and Partners can help.

What Does a Trump Victory Mean for the UK?

The re-election of Donald Trump could signal a significant shift in US immigration policies. Trump’s presidency from 2017 to 2021 was marked by stringent immigration reforms, including tightened visa requirements and travel bans targeting specific countries. While the UK was not directly affected by these bans, the broader restrictions could indirectly complicate processes for UK nationals by increasing the hurdles they need to overcome. According to our 2024 study, 57% of UK nationals are worried about how the results of the election could affect them.

A Trump victory could revive the "America First" policy, emphasising domestic employment and potentially reducing opportunities for foreign nationals in the US job market. Sectors such as tech and healthcare, which traditionally attract skilled professionals from the UK, might face stricter oversight and limited visa allocations. Moreover, Trump’s inclination toward bilateral negotiations could shift the focus to strengthening trade and economic ties with the UK, potentially impacting immigration dynamics positively or negatively. Until he assumes office in January, there is no way to be certain exactly how UK immigration to the US will be impacted. Although he has hinted towards mass deportation of undocumented immigrants, how his policies affect the UK remain to be seen. For the time being, our USA Desk will still be on hand to help with visa applications to the USA.

Will Immigration to the US Be Harder for UK Nationals?

US immigration policies are notoriously complex, and their rigidity often fluctuates based on the prevailing political climate. As Trump is returning to the White House, UK nationals could face additional scrutiny, especially in employment-based visa categories. Key visas like the H-1B for skilled workers and the L-1 for intra-company transfers may see reduced caps or heightened eligibility criteria, aimed at prioritising American workers.

Family-based immigration may also become more challenging under a Trump administration, given his prior advocacy for merit-based systems over family reunification. This could affect UK nationals hoping to join family members residing in the US.

During our 2024 study, we found that 29% of people think it should be easier for citizens of the UK and the US to move between the two countries, whether it be for living, working or leisure.

Ultimately, while immigration to the US remains accessible for UK citizens, political shifts in Washington could influence timelines and costs.

Applying for a Visa in the US from the UK

The process of applying for a US visa requires careful preparation. For UK nationals, the journey typically begins with determining the visa type that aligns with their purpose of travel, such as work, study, or family reunification. Popular visa categories include:

  • H-1B Visa: For specialised workers in fields like IT, engineering, and finance.
  • L-1 Visa: For employees transferring within the same company to a US office.
  • F-1 Visa: For students enrolling in US educational institutions.
  • K-1 Visa: For fiancés of US citizens.

Once the appropriate visa is identified, applicants must complete the DS-160 form and pay the associated application fees. This is followed by scheduling an interview at the US Embassy in London, where applicants must present documentation, including proof of financial stability, ties to the US and purpose of travel.

Delays and denials are not uncommon, often stemming from incomplete paperwork, insufficient evidence, or miscommunication during interviews. As a result, preparing thoroughly and seeking legal expertise can significantly enhance the chances of success.

  • Complex Cases: For individuals with prior visa denials, criminal records, or unique circumstances.

  • Family-Based Applications: Ensuring compliance with eligibility requirements for spouses or dependents.
